CASE SUMMARIES
- This DWKM&R client suffered significant injury to his temporomandibular joints (TMJ) when he bit down
on a ball bearing in a burrito purchased at Taco Bell. He reported the incident to the store manager who
recognized the ball bearing from a cheese dispenser used by the restaurant in its food preparation. Following
six months of aggressive non-surgical treatment, an oral surgeon determined that the 27-year-old man sustained
a permanent TMJ injury that requires permanent use of a night splint and dietary restrictions. Ken McKenna litigated
the man's case, resulting in a $73,000 verdict.
- This DWKM&R client was walking to dinner when she was struck from behind by the extended side view mirror of a bus;
the blow propelling her face first onto the pavement. She was rushed to a local hospital and underwent emergency surgery to
alleviate bleeding and swelling in her brain. The next day, an MRI revealed an epidural hematoma, requiring a second immediate
surgery. At the time, it was uncertain if she would survive. Eventually, two more surgeries were performed to replace her skull cap
and fasten it in place with a network of screws. She spent months in the hospital and required extensive rehabilitation
once released. Four months after the accident, she suffered a seizure, requiring her to take anti-seizure medication for the
rest of her life. She has been diagnosed with permanent brain injury, and a vocational rehabilitation specialist projected
that her vocational options were limited. DWKM&R, represented by Brian Wilson, negotiated a settlement of $2.2 million that
will compensate this client for her medical care and provide for her future medical and life care needs.
- A 23-year-old computer technician was accidentally shot in the abdomen with an assault rifle. As a result, he was
hospitalized for 22 days with life threatening injuries that included a shattered sacrum and bullet fragments in his
pelvis that could not be removed. These injuries devastated the young man. He battled insomnia, bowel and bladder
incontinence, back pain and impotence. He required extensive follow-up treatment and was not expected to return to work
any time soon. Represented by Brian Wilson, the young man received a settlement of $540,000 that included $40,000
contributed personally by the shooter's family.
- In this personal injury case, DWKM&R represented a woman who was brutally beaten by the defendant over a two year
period. The beatings broke both of her jaws and eye sockets. She lost several teeth and requires ongoing counseling.
The jury returned a verdict of nearly $1.3 million.
- In a complicated work site accident case, DWKM&R represented a man who suffered severe injury from a rock crushing
machine. The accident was partly caused by the negligence of another worker who was operating the crushing machine while
our client was performing his job. The authorities failed to perform a detailed and thorough investigation of the
accident, and it was only after years of difficult litigation, pretrial discovery and expert witness assistance that
DWKM&R was able to prove how and why the accident occurred. Despite significant obstacles in this case, DWKM&R secured
a settlement of $575,000.
